Freedom of Information
The Freedom of Information Act 2000 provides a general right of access to all types of recorded information held by any public body. The Civil Nuclear Police Authority is subject to the Act.
In developing its publication scheme, the Police Authority wishes to follow the spirit of the ACPO model publication scheme. Currently ACPO are reviewing their scheme along with the Information Commissioners Office and whilst the outcome of this review is awaited, the Police Authority has chosen to publish information under a number of the information classes which are presently offered to the general public. Please see below the information made available for the public under this new approach.
Requests received in Welsh
Upon receiving a request in Welsh under the Freedom of Information Act, we will provide an acknowledgement in both Welsh and English.
As the Civil Nuclear Police Authority does not have a dedicated professional Welsh language translation service internally, the first action upon receiving a request will be to approach our external Welsh language translation service and pay for a translation.
The official response will also be bilingual.
Any additional communications made during this process will be made in English as we are working within a constrained deadline and we do wish to respond within the 20 working days permitted.
Information Class -What we spend and how we spent it

Information Class - Minutes of Meetings "Executive Decision Meetings"
Comments - ACPO Class Definition: "In recognition of the need to have regard to the public interest in allowing access to public information held, and in the publication for reasons for decisions made, the 'open' session of ratified minutes of formal Force level decision making meetings are published. They contain discussion of key strategic issues under consideration and the primary decisions relating to resource and budgetary matters. The 'closed' session of the minutes are not available under this publication scheme. They contain information of a confidential and sensitive nature, e.g. personnel, security matters and commercial interests."
The function of the Civil Nuclear Police Authoirty is to ensure that the Civil Nuclear Constabulary is efficient and effective and meets the policing requirements of stakeholders in the nuclear industry in accordance with the strategic direction set by the Authority. Objectives and performance targets for the Constabulary are agreed between the Chief Constable and the Authority and are reviewed on a regular basis at Full Police Authority Meetings. These meetings are in effect the organisation's 'Executive Decision Meetings' as they not only review objectives and targets but judgements are also made on policies, procedures and operational / business developments when it is believed such areas will have an impact on the organisation's future performance.

Information Class - Policies "Our Policies"
Comments - ACPO Class Definition: "Here you will find current statements of principle providing guidance and direction to staff in respect of a specific issue or piece of legislation. Our policies establish the expected organisational behaviour in line with organisational objectives leading to a consistent approach to decision making. Our policies set out broad expectations and are the framework from which procedure flows."

Information Class - Performance "How Are We Doing"
Comments - ACPO Class Definition: "Here you will find information revealing our performance against national and Force objectives / targets and Best Value indicators which are required to be produced, as a minimum, on a quarterly basis for the Police Authority."

Comments - Police investigations are conducted with due regard to the confidentiality and privacy of victims, witnesses and suspects. Such investigations may also frequently involve the use of policing tactics or techniques that, if widely known, would hinder the ability of the police service to prevent and detect crime. It is further recognised that the release of information concerning current investigations may compromise any subsequent court proceedings.
If you have a request under this act which is not covered by the information provided above, please contact the Civil Nuclear Police Authority who has responsibility for all applications for the Civil Nuclear Constabulary.
• History of the Civil Nuclear Constabulary
For these reasons the police service will, in most cases, seek to apply an exemption to prevent the release of information concerning investigations when requested under the Freedom of Information Act, 2000.
Whilst adopting this general position, there is full recognition that in some cases there will be significant and compelling issues of public interest that require the disclosure of information. However, to override issues of personal privacy and possible harm to individuals involved in the investigation, this public interest must be significantly more than mere curiosity or interest in a particular investigation.
In order to ensure that these public interest issues are fully considered, all applications for information concerning investigations will be considered on a case-by-case basis in accordance with the requirements of the Act.
This is a statement designed to cut down the level of FoI requests in this area of business.
